MINUTES OF THE BYRON SHIRE COUNCIL Byron Shire Reserve Trust Committee HELD ON Thursday, 27 August 2015 COMMENCING AT 2.08PM AND CONCLUDING AT 2.16PM

PRESENT:   Cr A Hunter (Deputy Mayor), Cr B Cameron, Cr C Cubis, Cr D Dey, Cr P Spooner,
Cr R Wanchap and Cr D Woods

The Deputy Mayor opened the meeting and acknowledged that the meeting is being held on Arakwal Country and that we pay our respects to the elders past and present and extend our respect to the Bundjalung clans whose lands and waters are part of the Shire.

There was no public access

 

 

Apologies

 

There was an apology from Cr Ibrahim. Cr Richardson has previously been granted a leave of absence for this meeting.

 

Procedural Motion

Resolved that the apology from Cr Ibrahim be accepted and a leave of absence granted.

Declarations of Interest – Pecuniary and Non-Pecuniary

 

Cr Spooner declared a non-pecuniary interest in Report 4.3. The nature of the interest being that his employer runs markets in the Butler Street Reserve. Cr Spooner elected to leave the chamber, not participate in the debate and not vote.

Report No. 4.1             Brunswick Sculpture Walk Request for Approval to issue Temporary Licence

Resolved that the Reserve Trust grant a temporary licence, under section 108 of the Crown Lands Act, for the purpose of an “Exhibition”, to the Brunswick Heads Progress Association for part of the Brunswick Nature Sculpture Walk for the period 2 October to 6 October 2015 on Crown Reserve R97139, known as Venture Park and Brunswick Heads Beach.                                                                                                                                  (Woods/Cameron)

Report No. 4.2             Corporate Team Building Activities on Beach - Approval to issue a Temporary Licence

Resolved that the Reserve Trust grant a temporary licence, under section 108 of the Crown Lands Act, for the purpose of “Sporting and organised recreational activities”, to Pinnacle Events for Monday 9 November 2015 on Crown Reserve R97066, known as Tallow Beach.

Staff Reports - Infrastructure Services

 

Report No. 4.3             Section 34A Lease/Licence Application - Butler Street Reserve

File No:                        I2015/831

 

 

Cr Spooner left the chambers at 2.14pm in accordance with his earlier declared non-pecuniary interest in this item.

Resolved:

1.       That Council, as the Reserve Trust Manager of Byron Bay (R88993) Reserve Trust support a short-term 34A Lease/Licence with NSW Trade and Investment Crown Lands Division for part Butler Street Reserve, for the purposes of a temporary site compound, for the construction of Byron Bay Town Centre Bypass.

 

2.       That preference be given within the reserve to the area at the end of Somerset Street (marked yellow on the plan issued to Councillors in an email (insert doc number once scanned) of 25 August at 9:03am) and second preference to the area on the western side of the Reserve (marked in blue).                                                                               (Dey/Woods)

 

The motion was put to the vote and declared carried.

Cr Spooner was not present for the vote.

 

Cr Spooner returned to the meeting at 2.16pm.

 

     

 

 

There being no further business the meeting concluded at 2.16pm.
