Paul Spooner opened the meeting at 2.05pm and acknowledged that the meeting was being held on Bundjalung Country.

BUSINESS ARISING FROM PREVIOUS MINUTES (Verbal updates)

 

5.1     Public Art in new development – update

 

Rebecca Townsend presented new public art concepts for the new development in Byron Bay on the corner of Lawson and Fletcher Streets (Agcorp building). The current proposal includes three light-boxes attached to the external walls of the building on the Fletcher street side, with three different artworks by Kellie O’Dempsey. The light-boxes measure 175mm deep, 1. Is 2m2, 2. Is 2.8m x 1.8m and 3. Is 3.6m x 800mm. The artworks have an indigenous theme and the artist has consulted with Arakwal.

 

Action:

The Public Art Assessment Panel are very happy with the outcome and staff are to advise the relevant planning staff of this outcome.

 


6.1     Public Art on Byron Shire Water and Sewer Infrastructure

 

RECOMMENDATION 6.1:

 

That the Public Art Assessment Panel recommend that Council:

 

1.    Appoint Kelly Reiffer to undertake the Sewer Infrastructure commission on the following sewer pump stations:

·    choice of plants for the green wall on the Rec ground Recycled water station and maintenance.

·    That the alternative artwork, the owl, would not be appropriate due to too much white space for potential graffiti.

5.6     Ten Seats Project, Brunswick Heads

 

Kim Rosen spoke to the PAAP about the Ten Seats Project in Brunswick Heads. It fits with the Tweed Street Masterplan and is designed to provide some artwork (there is not much public art in Brunswick Heads) that interprets the history and culture of Brunswick Heads.

 

Seats installed so far are the History Seat (by Suvira McDonald) and the Community Seat (by Pauline Ross and the community) depicting flora and fauna of Brunswick Heads. The PAAP have already seen and supported concept designs for the Youth Seat (led by Kerry Stanton which will engage the youth of the town in both the design and building of the seat near the skatepark) and the Fishing Seat (led by Zac Tooth, an architect which will engage some of the older people in town like the Men’s Shed, Fishermen, etc).

 

The PAAP thanked Kim for volunteering on such a great project for the Brunswick Heads community.

 

5.2     Priority public art locations in Ocean Shores and Suffolk Park

 

Paula Cordeiro has been working with artist Wendy Mills and put together a document tabled at the meeting (attached to minutes) re public art for Ocean Shores.

 

RECOMMENDATION 5.2:

 

That the Public Art Assessment Panel recommend to Council to:

 

1.   Note the submission document tabled today (attached);

2.   Provide in principal support for public art in various locations in Ocean Shores;

3.   Recommend that the locations identified be the subject of further investigations with the appropriate Council staff with regards to land ownership and requirements.

Action:

The PAAP recommended that further community support for the project be found, preferably with a group of people that can help with fundraising and making the vision a reality.

 

5.3     Mullumbimby Sculpture Walk

 

·    Suvira was absent at the meeting but the PAAP congratulated him and Creative Mullumbimby on the sculpture and a great launch last Saturday.

·    Council has received a complaint from a member of the public around children’s safety at the sculpture site.

 

Action:

Staff to talk with Creative Mullumbimby about the plaque to be placed at the site and have the words ‘do not climb’ included.

 

5.4     Public Art Small Grants Program 2015

 

An acquittal has now been received for the Memorial Seat in Brunswick Heads small grant. The seat is now finished and a family memorial celebration was held at the seat on Anzac Day.

 

5.5      Pelican Sculpture update

 

Andy Erskine was absent and unable to give an update.

 

 

PUBLIC ART PROPOSALS

 

6.2     Public Art Proposal – Brunswick Nature Sculpture Walk re permanent sculpture

 

RECOMMENDATION 6.2:

 

That the Public Art Assessment Panel recommend to Council:

 

1.   to not support the purchase of the permanent sculpture “Oh My Cod” by David Walsh at this time, but to defer consideration until the completion of a regional analysis for purchasing and commissioning public art is completed.

 

2.   To write to Brunswick Nature Sculpture Walk with a suggestion to apply for Council’s next round of Events and Festivals Sponsorship Funding.

6.3     Public Art Proposal – Gillie and Marc

 

RECOMMENDATION 6.3:

 

That the Public Art Assessment Panel recommend to Council not to proceed with the Gillie and Marc offer to work with Byron Shire Council for the reasons outlined below:

 

1.    the artwork is not by a local artist

2.    the costs of materials and shipping the artwork to/from Sydney are not within the scope of the public art budget

3.    maintenance of a bronze sculpture would be significant and not within Council’s current resources.

6.3     Submissions to the Public Art Small Grants Program

 

RECOMMENDATION 6.3:

 

1.       That the Pubic Art Assessment Panel recommend to Council to support the submission from Chloe Rowland for the ‘Bangalow Wall’ community project with a small grant of $1,000.

 

2.       That the successful applicant be notified in writing and provided with a project/ grant acquittal and reporting mechanism for submission at the conclusion of the project.

That $500 small grants do not provide enough funds to undertake projects and that the 2017 round should increase the small grants to $1,000.

 

6.4     Public Art Proposal – Living on the Edge Project

 

Paul Spooner left the meeting at 4.10pm.

PLEASE NOTE THAT QUORUM WAS NOT MET FOR THIS LAST ITEM.

 

RECOMMENDATION 6.4:

 

That the Public Art Assessment Panel recommend to Council to provide permission to install the Living on the Edge Project artworks as detailed below:

 

1.       An Artwork (as attached) be permanently (for the life of the artwork) attached to the outside wall of the Mullumbimby Neighbourhood Centre facing Tincogan Street, pending further investigation around building ownership and heritage investigations.

 

2.       Other Artworks (as attached) be temporarily (for 3 months) be attached to bus stops:

 

a.   Byron Bay bus stop corner Carlyle and Jonson Streets, and

b.   Brunswick Heads bus stop on Brunswick Valley Way in between Access Road and Brunswick Terrace.

c.   A 1m x 1m temporary banner to the Jonson St toilet block.

Investigate building ownership and heritage for Mullumbimby and District Neighbourhood Centre.

Airspace over the Road Reserve Usage

On 12 November 2009, after considering a report title “PLANNING 10.2008.742.1 Great Northern Hotel 35-43 Jonson St Byron Bay, Council resolved Resolution 09-951, in part:

 

1.         That Council receive a further report on consent condition 49 regarding the lease value, terms and conditions for part of the public road reserve to be occupied by the proponents proposed balcony.

 

3.         That any other air space usage in Byron Bay be reviewed for consistency with lease/licence arrangements.

 

This report summarises the current position of lease arrangements in Byron Bay and recommends that Council undertake an audit of structures occupying the airspace over the public road reserve that have an approved use associated with commercial operations under the Environmental Planning and Assessment Act.

 

 

 

RECOMMENDATION[m3] :

 

1.       That Council undertake an audit of structures occupying the airspace over the public road reserve that have an approved use under the Environmental Planning and Assessment Act associated with commercial uses. 

 

2.       That a draft policy in relation to leasing of airspace used for commercial usage be prepared.

 

3.       That Council receive a report on the outcomes of the audit and draft policy for further consideration.

 

 

 

 

 

 


Report

 

At its Ordinary Meeting of 12 November 2009 Council considered a report PLANNING 10.2008.742.1 Great Northern Hotel and resolved [09-951]:

 

1.         That Council receive a further report on consent condition 49 regarding the lease value, terms and conditions for part of the public road reserve to be occupied by the proponents proposed balcony.

 

2.         That the Great Northern footpath area licence/lease be reviewed to increase the width of public access by reducing the 3m dining area to 2m and extending the area of lease to accommodate the approved tables and chair numbers to provide necessary public access.

 

3.         That any other air space usage in Byron Bay be reviewed for consistency with lease/licence arrangements.

 

This report deals with parts 1 and 3 of resolution [09-951].   Resolution part 2 will be the subject of a further report to Council, once a policy position regarding the terms and conditions and lease values has been adopted by Council.

 

In relation to part 3 of the resolution “That any other air space usage in Byron Bay be reviewed for consistency with lease/licence arrangements” a brief desktop review was undertaken of a number of commercial premises with balconies constructed in the road reserve.  This review revealed inconsistencies in that;

 

(a)        Council has one current lease for balconies occupying airspace over the public road reserve, and

 

(b)        there are commercial premises with balconies constructed in the Shire, that have development consents that do not require tenure arrangements with Council for occupation of the airspace over the road reserve.

 

Considerations Moving Forward

 

As commercial uses for balconies vary, the lease fee would be dependent on proposed use.  For example, a balcony adjoining retail shop space would attract a significantly different market value to a balcony adjoining commercial office space.

 

In addition to the proposed use affecting lease fees, the lease term would also impact upon the attainable lease fee.  The Roads Act 1993 provides for that a term for lease of airspace, together with any option to renew, must not exceed 99 years.  Any lease term of more than 3 years however must be registered.  This would incur legal and registration costs.  To extend the term of lease over 5 years, a subdivision of the land would be required.  In the case of airspace, a subdivision and registration as a stratum would be required.  The costs involved in this process can range from $5,000 to $10,000.

 

In relation to the terms and conditions for lease, Section149 of the Roads Act 1993 provides that the Roads Authority may lease the air space above the surface of any public road owned by the authority, only with the approval of the Director of Planning.

 

The Director of Planning must not approve a lease inconsistent with the rights of passage and access that exist with respect to the road.  Section 149 of the Roads Act is contained in the Statutory and Policy Compliance Implications of this report.

 

 

 

Recommendation

 

In order to ensure a consistent approach to assessment and lease of both existing and future use of public road reserve this report recommends:

 

1.       That staff undertake an audit of existing commercial structures in public road reserve in Byron Bay; and

 

2.       That staff prepare a draft policy in relation to leasing of airspace above the road reserve for Commercial Uses.

 

and provide a further report back with the outcomes of the audit together with a draft policy for Council’s consideration.

 

History

 

After considering a report entitled “Leasing of Airspace” at its Ordinary Meeting dated 16 May 2000 Council resolved in part [00-359] “That staff prepare a policy for consideration by Council the future leasing of airspace over public roads”.

 

A draft policy was researched, prepared and provided to Council on 19 February 2002.  Council resolved [02-74] “…advertise the draft airspace leasing policy…for public comment for 28 days.”

 

The draft policy was advertised on 6 June 2002.  No submissions were received in response to the advertising.  However, during the advertising period a number of issues were further investigated, prompted by concerns about the length of the proposed leases:

 

i.        The possibility of requiring an airspace lease retrospectively

ii.       Possible methods of determining an appropriate lease fee

iii.      Whether an airspace lease would be required for all structures constructed over a footpath (that is, would an airspace lease be required for awnings, or only for usable space such as a deck or verandah)

iv.      The legality of the lease term proposed by the policy

v.       Required authorisation for airspace leases

 

As a result of those investigations the draft policy was redrafted to provide a more comprehensive approach.  That revised draft was presented back to Council at its meeting of 28 June 2005, with a recommendation to place the draft amended “Leasing of Airspace Policy” on public exhibition for a period of 28 days.

 

At its Ordinary Meeting of 28 June 2005, Council resolved [05-475]:

 

That Council abandons any further development on the Policy- Leasing of Airspace.”

 

Financial Implications[m4] 

 

Minimal in regard to the recommendation. The audit and the preparation of the draft Policy and the report to Council could be undertaken using exisiting resources.

 

Statutory and Policy Compliance Implications[m5] 

 

Council have the power, with the consent of the Director of Planning, to issue the proposed lease under Section 149 of the Roads Act.  There are no requirements to provide public notice of an intention to issue a lease for land above the surface of a road.

 

Under sections 23F and 23G Conveyancing Act 1919, a lease for more than 5 years including any option of renewal must be defined as a lot in a current registered plan.  Further a lease for less than 5 years must be defined as a lot in a current registered plan if the parties require the lease to be registered.

 

Therefore if the proposed lease is to be longer than 5 years, or less than 5 years but registered, a strata subdivision of the road reserve would be required to create a lot in a strata plan for identification purposes for the lease.  Strata subdivision of a road reserve is permissible under s259 of the Roads Act.

 

Roads Act 1993

149    Leasing of land above or below public road

(1)     A roads authority may lease the air space above, or land below the surface of, any public road (other than a Crown road) that is owned by the authority.

(2)     Such a lease may not be granted by a roads authority other than the RTA except with the approval of the Director of Planning.

(3)     The Director of Planning must not approve a lease in respect of a public road if the granting of the lease would be inconsistent with the rights of passage and access that exist with respect to the road.

(4)     The term of a lease, together with any option to renew, must not exceed 99 years.

 

259    Exercise of certain functions may be limited to stratum

Any function that may be exercised under this Act with respect to land may be restricted to:

 

(a)     land down to a specified depth below the surface of the land, or

(b)     airspace up to a specified height above the surface of the land, or

(c)     land lying between specified depths below the surface of the land, or

(d)     airspace between specified heights above the surface of the land, or

(e)     land and airspace between a specified depth below, and a specified height above, the surface of the land.

 

Conveyancing Act 1919

23F   Certain transactions to refer to lots shown on current plan

(1)     This section applies to the following transactions:

 

(a)     the conveyance or transfer of part of an existing lot,

(b)     the lease of part of an existing lot,

(c)     the mortgage of part of an existing lot,

(d)     the partition of an existing lot.

 

(2)     The Registrar-General may refuse to register a transaction to which this section applies unless:

 

(a)     the land to which the transaction relates is shown on a current plan, and

(b)     the boundaries of each part into which the land is divided as a result of the transaction follow the boundaries of an existing lot.

 

23G   Exceptions to sec 23F

Section 23F does not apply to the following transactions:

 

(d)     a transaction that comprises:

(i)    the lease of part of an existing lot for a period that, including the period of any option to renew, does not exceed 5 years, or

(ii)   the transfer, conveyance, sublease, variation or mortgage of a leasehold interest so created,

 

(e)     a transaction that comprises:

(i)    the lease of the whole or any part of a building, or

(ii)   the transfer, conveyance, sublease, variation or mortgage of a leasehold interest so created,

This report outlines costs in the Environment & Landcare program and recommends fees increases in the Certification Unit and the commencement of action to charge for air space lease.

 

 

 

RECOMMENDATION[m8] :

 

1.       That Committee recommend to Council:

 

(i)         That it amend the 2011/12 fees and charges prior to adoption to increase all certification fees to $155 per hour.

 

(ii)        Council consider charging for airspace leases over roadways / footpaths and direct that a policy be prepared.

Council at its Ordinary Meeting held on 28 April 2011 resolved via Resolution 11-347 as follows:

This report has been prepared in relation to Part f of Resolution 11-347. The other Parts of the Resolution have been addressed in separate reports to this meeting of the Strategic Planning Committee.

 

The issues relating to Landcare are addressed in a separate report to this meeting prepared by the General Manager.  This report therefore only examines issues that relate to income generation.

 

There are 2 important areas where income generation can be achieved. 

 

Air space leases

 

Council has received previous reports with regard to air space leases without satisfactorily resolving the issues.  There are at least 3 premises that are known to have conditions of consent requirements for air space leasing.

 

These premises have an unfair advantage compared to their competitors who have footpath dining and paid $688.00 per annum, per sq metre.  One prominent premises in Jonson Street pays $16,000 per annum to Council for footpath dining based on this rate where as the 3 competitors in this area of Jonson Street who have restaurants on balconies pay no lease charges at all.

At a conservative lease fee (subject to valuation) of $300.00 per annum per square metre an income of $42,000 per annum would be achieved just from these known premises.

 

If Council adopt an airspace policy it would have to be uniformly applied across the Shire and its likely that other premises would be identified as requiring airspace leases.

 

There are at least two other premises that will be constructing balconies for restaurant use, and an audit of other types of commercial uses over footpaths would be required.

 

Certification Unit

 

Council is required to provide a Principal Certifying Authority service under Section 109E of the EPAA Act and under 74A of the Building Professionals Act. This does not prevent Council from contracting out this service however the level of service that is required to be provided would be to Level 1 certification (fire engineering) to which there are a limited number of Private Building Professionals within the industry who attract a premium due to availably.

 

Prior to the requirement of registration of Council Accredited Certifier in September 2010 a review of the availability of Level 1 Accredited Certifiers was undertaken to assess the viability of outsourcing this service however at the time the cost associated with using external Level 1 Accredited Certifiers was greater than using Council staff.   Council is in a position to independently review the comparison of providing this a service internally or by private certifiers

 

Subdivisional Certificates are issued by Council as required by Section 109D(d) of the Environment Planning and Assessment Act with the exception of Strata Title Developments which can be issued by Private Certifiers.  From time to time Council has employed consulting civil engineers to assist in the delivery of this service but the rate per hour has found to be much more expensive that Council Engineers.

 

As indicated Council provides an economical certification service however should Council wish to make additional income from the services it provides, Council could increase fees and charges (which are not regulated). Increased hourly service fees have already proposed in the 2011/12 draft budget.

 

The 2010/11 fees and charges current a provide for a fee of $130.00 per hour for certification services such hourly service fees for certification services could be increased to $155.00 per hour in the 2011/12 budget to achieve this 20% increase. 

 

In a competitive market there may also be a minor decrease in the potential income as Council's customers shop around for the best price. Even with an increase of 20% on certification fees, Council should be competitive in the market.

 

The additional income per annum likely with a 20% increase will $73,500 provided that the market share is retained. 

 

Financial Implications[m9] 

 

Council is in a position to charge for air space leasing over public lands and can achieve additional income in the Certification Unit.

Byron Shire Council’s Preliminary Submission on the draft North Coast Regional Plan

Overview

 

The State Government released a draft North Coast Regional Plan (NCRP[s11] ) for public comment with submissions due by 2 June 2016. Council welcomes the opportunity to continue discussions with the Department of Planning and Environment about the draft NCRP and to make a formal submission, as input from affected councils is considered to be vital to the success of the Plan.

It is understood that the NCRP will:

·    have a planning horizon to 2036 providing guidance to the five Far North Coast Councils as well as the Mid North Coast and Lower North Coast for the next 20 years;

·    once adopted by the State government, will replace The Far North Coast Regional Strategy which as been in effect since 2006 (NCRP, p15[s12] ); 

·    require all councils to implement the objectives and actions of the final Plan, appropriate to their local area, in their council planning strategies and local environmental plans. (NCRP, p15)

Staff have reviewed the draft NCRP and considered the impact of its objectives and actions with regard to the needs of the Byron community.  The key issues and recommendations relating to this submission, as identified by staff, are presented in Table 1 below.

It should be noted that staff have also provided advice to the NOROCs submission representing the five North Coast Councils.

1)   Include separate narratives for each local government area in the final NCRP .

The narratives would consist of a context statement provided by each local government authority that summaries housing, economic and employment opportunities as identified in local growth management strategies.   Such statements would capture local planning expectations such as Byron Shire's focus on agricultural, creative and tourism industries and maintaining low rise residential in its urban areas (a good example can be found in the South East Queensland Regional Plan 2009-2031).

 

2)   Level of Local Government representation on Coordination and Monitoring Committee should ensure:

a)   there is capacity for at least 1 representative from each subregion;

b)   the position as a representative is on a rotational basis to enable all local government authorities to participate at given intervals; and

c)   clarification is provided as to whether it will be an officer or an elected representative

 

3)   NCRP Directions/Actions:

a)   Provide clearer guidance on the implementation aspects for each of the Actions (including indicators/measures for the Plans effectiveness and monitoring) to assist local councils with their forward planning and budgeting

The directions and actions that underpin the NCRP framework are very ‘light on’ and lack the specificity of language required to deliver consistent outcomes across the North Coast. No detail is provided on the responsibility, means and timing for the delivery of each action, as well as performance measures to indicate success.

 

As the delivery of certain actions will have resourcing and financial implications for all councils the NCRP should set out a clear framework for their delivery.  This will enable councils to consider as part of their meeting ‘fit for the future’ requirements and incorporate in their operational plans

 

4)   Clear guidance on document and mapping reviews identified, namely:

a)   Rationale and terms of reference

The NCRP should identify what outcomes are being sought from the review of Urban Design Guidelines and Farmland Mapping Project.

b)   Timing:

Some review actions ideally should be undertaken prior to finalisation of the strategy, such as the Farmland Review Mapping project.

 

 

5)   State and regional policy linkages: the NCRP should include an appendix that lists relevant state and regional policy documents that relate to the delivery of a given NCRP action.

 

As the NCRP has not been developed as an ‘all of government’ regional plan it would be useful to include an appendix listing any state and regional policy documents relating to the delivery of a given NCRP action.  An example taken from the Central Queensland Regional Plan is provided in Figure 1 below.

6)   Community identity and building: The NCRP should include a community engagement framework to govern preparation of local planning / growth management strategies, together with an associated Action to implement this framework.

 

7)   LEP Provisions and Housing Diversity: The Standard Template LEP should be amended to enable Councils to identify average dwelling density targets for new urban release areas, as mechanism for delivering greater housing diversity across the region (Action 3.2.1 – p58).

 

8)   Sustainable Transport: The NCRP should include a new Action focused on encouraging sustainable transport in  the local planning / growth management strategy making processes. 

 

9)   Strengthen Policy positions under individual goals as follows:

 

 

a)   Goal 1: A natural environment, Aboriginal and historic heritage that is protected and landscapes that are productive

 

It is recommend that the NCRP:

i)    identify key ‘landscapes’ for protection on Figures 3 and 7

ii)   provide a policy position to guide future planning for composite landscapes and any related actions

The NCRP also needs to consider farmland, national parks and state forests at a landscape scale, as a multifaceted productive landscape rather than separate land uses[s13] . Other regional planning areas with similar landscapes such as the Far North Queensland and the Moreton and Sunshine Coast Regions identify composite landscapes using the labels of ‘Landscape and Rural Production Area’ and ‘Inter-urban breaks’ respectively.

iii)  retain Action from the Far North Coast Regional Strategy for local environmental plans “to  include provisions to encourage habitat and corridor establishment in future zoning of Environmental Assets and Rural Land area”

iv)  include a specific action for world heritage features such as the Gondwana rainforest, that places greater emphasis on avoiding impacts and optimizing conservation outcomes

v)   include guidelines for local government on heritage investigation, assessment and management based on the five APEC (Aboriginal people, the environment and conservation) principles adopted by OEH:

·    Spirituality and Connection

·    Cultural Resource Use

·    Wellbeing

·    Caring for Country

·    Doing Business with Aboriginal People

 

vi)  include an additional objective relating to Aboriginal people’s connection with and use of land/country, similar to the Coastal Zone Management Plan guidelines.

Such an objective would improve the way the community understands and values its heritage, embedding Aboriginal/traditional culture in mainstream policy and planning.

vii) provide a clearer framework for application of ‘State and Regionally Significant Farmland Interim Variation Criteria’

The interim criteria have the potential to be applied in a piecemeal and inconsistent manner and not consider significant farmland in a state and regional context.   The application of the criteria as currently provided is very open to interpretation and would benefit from:

•           more practical case study examples of how the first 3 criteria should be applied (agricultural capability, land use conflict; and infrastructure); and

•           clarification of the threshold (or other methodology) for determining whether or not mapped state/regionally significant farmland will contribute "significantly” to future agricultural production.

 

b)   Goal 2: Focus growth opportunities to created great place to live and work

 

It is recommend that the NCRP:

i)    include an Action for the State government to work with all councils not just regional cities to improve planning provisions to promote housing diversity and employment opportunities in line with the current FNCRS identification of this area as ‘a region of villages

ii)   clarify that variation principles can apply to both residential and employment/economic purposes;

iii)  ‘Urban Growth Area Variation Principles’ (Table 3) include wording to enable councils to vary the respective growth boundaries following identification in an adopted growth strategy;

iv)  include in the ‘aims on page 36 (dot points ‘2’ and 4’) specific reference to protecting significant farmland, to be consistent with Direction 1.2 Protect and enhance productive farmland (Goal 1).

v)   give consideration to a review of the Settlement Planning Guidelines to ensure alignment with the NCRP planning directions.

 

c)   Goals 1 & 2: 

i)    Ensure message consistency in regard to the actions under both of these goals ¾ namely the aim of protecting significant farmland when identifying future urban and rural residential land in a local strategy.

 

d)   Goal 3: Housing choice, with homes that meet the needs of changing communities

 

It is recommend that the NCRP:

i)    identify West Byron urban release area (Byron Bay) as a priority site for access to the NSW Government’s ‘Housing Acceleration Fund’.

ii)   recognise the important role of community engagement, local community values and sense of belonging in future growth plans

 

e)   Goal 4: A prosperous economy with services and infrastructure

f)    Goal 5: Improved transport connectivity and freight networks

 

It is recommended that the NCRP incorporate an Action that provides a stronger linkage between land use and infrastructure planning through a framework that supports:

i)    coordination, prioritising and sequencing of infrastructure through local growth management strategies, budgets and local environmental plans

ii)   alignment and coordination of infrastructure plans, priority and budgets of state agencies with the NCRP and local government plans

iii)  development of mechanisms that support the best delivery options

iv)  better management of consumer demand and behaviour to minimise the need for additional infrastructure services

 

It is recommended that the NCRP include a sustainable tourism ‘framework’ [s14] addressing:

(1)  localised community consultation and culturally appropriateness as a core principle for large scale tourism 

(2)  the role of small scale tourism of our other towns and villages in the Shire

(3)  the role of Councils in the development of servicing plans for major annual festivals

(4)  need for revisions to the regulatory provisions to ensure an appropriate balance between:

(a)  environmental protection and eco-tourism opportunities

expectations of visitors, holiday letting property owners, the local community and impacts on permanent residents including housing /rental access and diminished amenity(b)

2.   Compliance with Building Code of Australia and insurance requirements under the Home Building Act 1989

(1)          For the purposes of section 80A (11) of the Act, the following conditions are prescribed in relation to a development consent for development that involves any building work:

(a)  that the work must be carried out in accordance with the requirements of the Building Code of Australia ,

(b)  in the case of residential building work for which the Home Building Act 1989 requires there to be a contract of insurance in force in accordance with Part 6 of that Act, that such a contract of insurance is in force before any building work authorised to be carried out by the consent commences.

 

(2)          This clause does not apply:

(a)  to the extent to which an exemption is in force under clause 187 or 188, subject to the terms of any condition or requirement referred to in clause 187 (6) or 188 (4), or

(b)  to the erection of a temporary building.

 

(3)          In this clause, a reference to the Building Code of Australia is a reference to that Code as in force on the date the application for the relevant construction certificate is made.

 

3.   Erection of signs

(1)          For the purposes of section 80A (11) of the Act, the requirements of subclauses (2) and (3) are prescribed as conditions of a development consent for development that involves any building work, subdivision work or demolition work.

 

(2)          A sign must be erected in a prominent position on any site on which building work, subdivision work or demolition work is being carried out:

(a)  showing the name, address and telephone number of the principal certifying authority for the work, and

(b)  showing the name of the principal contractor (if any) for any building work and a telephone number on which that person may be contacted outside working hours, and

(c)  stating that unauthorised entry to the work site is prohibited.

 

(3)          Any such sign is to be maintained while the building work, subdivision work or demolition work is being carried out, but must be removed when the work has been completed.

 

(4)          This clause does not apply in relation to building work, subdivision work or demolition work that is carried out inside an existing building that does not affect the external walls of the building.

 

(5)          This clause does not apply in relation to Crown building work that is certified, in accordance with section 109R of the Act, to comply with the technical provisions of the State’s building laws.

 

(6)          This clause applies to a development consent granted before 1 July 2004 only if the building work, subdivision work or demolition work involved had not been commenced by that date.

 

Note: Principal certifying authorities and principal contractors must also ensure that signs required by this clause are erected and maintained (see clause 227A which currently imposes a maximum penalty of $1,100).

 

4.   Notification of Home Building Act 1989 requirements

(1)          For the purposes of section 80A (11) of the Act, the requirements of this clause are prescribed as conditions of a development consent for development that involves any residential building work within the meaning of the Home Building Act 1989.

(2)          Residential building work within the meaning of the Home Building Act 1989 must not be carried out unless the principal certifying authority for the development to which the work relates (not being the council) has given the council written notice of the following information:

 

(a)  in the case of work for which a principal contractor is required to be appointed:

(i)    the name and licence number of the principal contractor, and

(ii)   the name of the insurer by which the work is insured under Part 6 of that Act,

(b) in the case of work to be done by an owner-builder:

(i)    the name of the owner-builder, and

(ii)   if the owner-builder is required to hold an owner-builder permit under that Act, the number of the owner-builder permit.

 

(3)          If arrangements for doing the residential building work are changed while the work is in progress so that the information notified under subclause (2) becomes out of date, further work must not be carried out unless the principal certifying authority for the development to which the work relates (not being the council) has given the council written notice of the updated information.

 

(4)          This clause does not apply in relation to Crown building work that is certified, in accordance with section 109R of the Act, to comply with the technical provisions of the State’s building laws.

 

5.   Concurrent Approvals

The following approvals are provided under Section 78A of Environmental Planning and Assessment Act:

 

Concurrent Approvals under Section 68 of the Local Government Act 1993

 

Part B        Water supply, sewerage and stormwater drainage work

B5     Carrying out stormwater drainage work

 

 

The following conditions are to be complied with prior to issue of a Construction Certificate for building works

 

6.   Plans of retaining walls and drainage

The application for a Construction Certificate is to include plans and specifications that indicate retaining walls or other approved methods of preventing movement of the soil, where any excavation or filled area exceeds 600mm in height. Adequate provision must be made for drainage.

 

The drainage design shall include a “cut off” drain at the boundary with number 35 Rankin Street and number 2 Ferguson Court to ensure that surface water or swimming pool overflow is directed to the stormwater system on Ferguson Court.  Rain water tank overflows must also be directed to the stormwater system on Ferguson Court.  

 

Such plans and specifications must be approved as part of the Construction Certificate.

 

7.   Water and Sewerage - Section 68 approval required

An Approval under Section 68 of the Local Government Act 1993 to carry out water supply work and sewerage work must be obtained.

 

8.   Internal Driveway details required

The application for a Construction Certificate is to include plans and specification that indicate vehicular access from the site boundary to the proposed car space(s). Vehicular access must be in accordance with AS 2890.1-2004: Parking facilities, Part 1: Off-street car parking. Plans are to include the following items:

 

a)      pavement description;

b)      site conditions affecting the access;

c)      existing and design levels;

d)      longitudinal section from the road centreline to the car space(s);

 

NOTE: The plans must be in compliance with Council's current “Northern Rivers Local Government Development Design & Construction Manuals and Standard Drawings”.

 

 

9.   Compliance with BASIX Certificate requirements

The development is to comply with BASIX Certificate No. 6476185_03, dated 9 May 2016 (dwelling) and BASIX Certificate No. A224022_02, dated 12 May 2016.

 

The commitments indicated in the Certificates are to be indicated on the plans submitted for approval of the Construction Certificate.

 

Note that the plans submitted must clearly indicate all windows numbered or identified in a manner that is consistent with the identification on the BASIX Certificate.

 

Minor changes to the energy efficiency measures may be undertaken without the issue of any amendment under Section 96 of the Act, provided that the changes do not affect the form, shape or size of the building.

 

Proposed colours must be consistent with the provisions of Section D1.2.4 of Council’s Development Control Plan 2014. Note that white colours are not permissible.

 

Such plans and specifications must be approved as part of the Construction Certificate.

 

10. Site Waste Minimisation and Management Plan

A Site Waste Minimisation and Management Plan (SWMMP) must be submitted outlining measures to minimise and manage waste generated during demolition, construction and the ongoing operation and use of the  development. The SWMMP must specify the proposed method of recycling or disposal and the waste management service provider.

 

A template is provided on Council’s website to assist in providing this information.

 

The following conditions are to be complied with prior to any building or construction works commencing

 

11. Plumbing Standards and requirements.

All Plumbing, Water Supply and Sewerage Works shall be installed and operated in accordance with the Local Government Act 1993, the NSW Code of Practice for Plumbing and Drainage and AS/NZS 3500 Parts 0-5, the approved plans (any notations on those plans) and the approved specifications. The changes made are from Plumbers and Drainage Regulation 2012 NSW Government.

a)   The licensee is to provide 24 hours notice and attend the site for the following INSPECTIONS, prior to covering of work. Inspections will be carried out a mutually convenient time:

 

i) Pre-start and Sediment Control;

ii)         Internal Drainage;

iii)         External Drainage;

iv)        Water Rough In;

v)         Fire Services;

vi)        Stackwork;

vii)       Final - all work completed. - * Note below.

 

b)   A licensee is required to provide to Council and owner of the property after completion of the work and within 48 hours, a Compliance Certificate and Sewer Services Diagram/ Works as Executed drawings.

 

Note: Council will send each plumber proformas of these documents when the Notice of Work permit has been issued by Council to allow the plumber to commence work.

 

 

12. Erosion and Sediment measures

Erosion and sedimentation controls are to be in place in accordance with the Guidelines for Erosion & Sediment Control on Building Sites. A copy may be downloaded from Council’s web site at http://www.byron.nsw.gov.au/pdfs/stormwater/sediment_erosion.pdf. Particular attention is to be given to the provision of the following sediment and erosion control measures:

 

a)      Temporary driveway from the edge of road to the building site;

b)  Temporary downpipes immediately installed after the roof has been erected;

c)      Silt fence or sediment barrier.

 

Sediment and erosion control measures must be maintained at all times until the site has been stabilised by permanent vegetation cover or hard surface.

 

 

Note: Council may impose on-the-spot fines for non-compliance with this condition. 

Any such measures that are deemed to be necessary because of the local conditions must be maintained at all times until the site is made stable (i.e. by permanent vegetation cover or hard surface).

 

 

13. Bond required to guarantee against damage to public land

 

A bond of $2000 is to be paid to Council as guarantee against damage to surrounding public land and infrastructure during construction of the proposed development. Evidence is to be provided to Council indicating the pre development condition of the surrounding public land and infrastructure. Such evidence must include photographs. The proponent will be held responsible for the repair of any damage to roads, kerb and gutters, footpaths, driveway crossovers or other assets.

Such bond will be held until Council is satisfied that the infrastructure is maintained/repaired to pre development conditions and that no further work is to be carried out that may result in damage to Council’s roads, footpaths etc.

 

 

14. Long Service Levy to be paid

 

A Long Service Levy must be paid to the Long Service Payments Corporation.  This is a State Government Levy and is subject to change.

These payments may be made online at www.longservice.nsw.gov.au or at Council’s Administration Office, Station Street, Mullumbimby. Where paying to Council, cheques are to be made payable to ‘Byron Shire Council’.

The following conditions are to be complied with during construction

 

15. Construction times

Construction works must not unreasonably interfere with the amenity of the neighbourhood. In particular construction noise, when audible from adjoining residential premises, can only occur:

 

a)    Monday to Friday, from 7 am to 6 pm.

b)    Saturday, from 8 am to 1 pm.

 

No construction work to take place on Saturdays and Sundays adjacent to Public Holidays and Public Holidays and the Construction Industry Awarded Rostered Days Off (RDO) adjacent to Public Holidays.

 

Note: Council may impose on-the-spot fines for non-compliance with this condition. 

 

16. Construction Noise

Construction noise is to be limited as follows:

a)      For construction periods of four (4) weeks and under, the L10 noise level measured over a period of not less than fifteen (15) minutes when the construction site is in operation must not exceed the background level by more than 20 dB(A).

b)      For construction periods greater than four (4) weeks and not exceeding twenty‑six (26) weeks, the L10 noise level measured over a period of not less than fifteen (15) minutes when the construction site is in operation must not exceed the background level by more than 10 dB(A)

 

Note: Council may impose on-the-spot fines for non-compliance with this condition.

 

 

17. Builders rubbish to be contained on site

All builders rubbish is to be contained on the site in a ‘Builders Skips’ or an enclosure. Footpaths, road reserves and public reserves are to be maintained clear of rubbish, building materials and all other items.

 

18. Toilet facilities

Toilet facilities are to be provided, at or in the vicinity of the work site at the rate of one toilet for every 20 persons or part of 20 persons employed at the site. Each toilet provided must be a standard flushing toilet connected to a public sewer or other approved system.

 

19. Prevention of water pollution

Only clean and unpolluted water is to be discharged to Council’s stormwater drainage system or any watercourse to ensure compliance with the Protection of Environment Operations Act.

 

Note: Council may impose on-the-spot fines for non-compliance with this condition. 

 

 

The following conditions are to be complied with prior to occupation of the building

 

20. Works to be completed prior to issue of a Final Occupation Certificate

All of the works indicated on the plans and approved by this consent, including any other consents that are necessary for the completion of this development, is to be completed and approved by the relevant consent authority/s prior to the issue of a Final Occupation Certificate.

 

Any Security bond paid for this application will be held until Council is satisfied that no further works are to be carried out that may result in damage to Council’s road/footpath reserve.

 

 

 

 

 

21. Internal driveway in accordance approved plans

A driveway is to be constructed from the property boundary to the proposed car space(s) in accordance with the approved plans.

 

22. Stormwater disposal

Stormwater must be collected and disposed of in a controlled manner such that stormwater flows are:

a)      Clear of buildings and infrastructure,

b)      Clear of effluent disposal areas,

c)      Not concentrated so as to cause soil erosion,

d)      Not directly to a watercourse, and

e)      Not onto adjoining land.

 

23. Swimming pool fencing 

Swimming pool fencing is to comply with the requirements of the Swimming Pool Act 1992 and Regulations.

 

 

The following conditions are to be complied with at all times

 

24. Relationship to Principal Dwelling

 

The secondary dwelling must remain on the same lot as the principal dwelling.

 

25. Use of Dwelling Houses

 

The secondary dwelling is not to be used for holiday letting and/or as a tourist facility.

 

26. No more than the principal dwelling and secondary dwelling

 

There must not be any dwelling on the land other than the principal dwelling and the secondary dwelling.

 

 

Notes

 

Consent granted under the Roads Act 1993

The following works in the road reserve are granted consent pursuant to Section 138 of the Roads Act 1993.

 

·    Gutter crossing and driveway from the kerb to the property boundary.

 

This consent is issued by Byron Shire Council, being the road authority, for the above proposed works and/or structures subject to the following conditions:

 

1)      Gutter crossing and driveway are to be constructed in accordance with Council's current “Northern Rivers Local Government Development Design & Construction Manuals and Standard Drawings”.

2)      All work is to be in accordance with Council’s adopted standards.

a)      Twenty four hours’ notice must be given for the following required inspections:
upon placing of all formwork and reinforcement, prior to pouring concrete, and

b)      upon completion of all work.

3)      All care is to be taken to ensure the safety of the public in general, road users, pedestrians and adjoining property.  The developer and/or contractor must produce evidence to Council of Public Liability Insurance cover for a minimum of $10 Million prior to the commencement of any works.  Council is to be named as a Principal in the policy.  Council is not be held responsible for any negligence caused by the undertaking of the works.

Water Pressure

 

Byron Shire Council cannot guarantee adequate flow and pressure from the existing water connection for the simultaneous demand of 2 dwellings. In the event an upgrade is required all costs will be the landowner’s responsibility.

 

Development Contributions

 

Council resolved not to charge Section 94 contributions for secondary dwellings under SEPP (Affordable Rental Housing Policy) 2009 subject to the following requirements:

 

a) That the maximum size of the secondary dwelling or granny flat does not exceed 60sqm.

b) That the floor space ratio for the whole development of the site does not extend beyond the 0.5:1 and that 25% of the site must be covered by absorbent surfaces such as lawn or landscaping.

c) That the secondary dwelling or granny flat does not increase the overall number of bedrooms on the site to greater than 5.

d)That the applicant has applied for a secondary dwelling or granny flat and specifically advised that the development is not to be used for tourism purposes and accepts a condition of consent to the same effect.

 

Section 94 Contributions have not been charged on this application based on the above criteria.  Should any of the above conditions change your development may be referred to Council's Compliance Department for further action.

 

 

Reasons for Imposing Conditions

 

Conditions have been imposed for the following reasons:

 

·    To comply with the provisions of Byron LEP 2014 and DCP 2014

·    To ensure the development is completed in accordance with conditions of consent and approved plans.

2)      Compliance with Building Code of Australia and insurance requirements under the Home Building Act 1989

(1)        For the purposes of section 80A(11) of the Act, the following conditions are prescribed in relation to a development consent for development that involves any building work:

(a)        that the work must be carried out in accordance with the requirements of the Building Code of Australia;

(b)        in the case of residential building work for which the Home Building Act 1989 requires there to be a contract of insurance in force in accordance with Part 6 of that Act, that such a contract of insurance is in force before any building work authorised to be carried out by the consent commences.

(2)        This clause does not apply:

a.   To the extent to which an exemption is in force under clause 187 or 188, subject to the terms of any condition or requirement referred to in clause 187(6) or 188 (4); or

b.   To the erection of a temporary building.

(3)        In this clause, a reference to the Building Code of Australia is a reference to that Code as in force on the date the application for the relevant construction certificate is made.

3)      Erection of signs

(1)        For the purposes of section 80A(11) of the Act, the requirements of subclauses (2) and (3) are prescribed as conditions of a development consent for development that involves any building work, subdivision work or demolition work.

(2)        A sign must be erected in a prominent position on any site on which building work, subdivision work or demolition work is being carried out:

(a)  showing the name, address and telephone number of the principal certifying authority for the work, and

(b)  showing the name of the principal contractor (if any) for any building work and a telephone number on which that person may be contacted outside working hours, and

(c)  stating that unauthorised entry to the work site is prohibited.

 

(3)        Any such sign is to be maintained while the building work, subdivision work or demolition work is being carried out, but must be removed when the work has been completed.

(4)        This clause does not apply in relation to building work, subdivision work or demolition work that is carried out inside an existing building that does not affect the external walls of the building.

(5)        This clause does not apply in relation to Crown building work that is certified, in accordance with section 116G of the Act, to comply with the technical provisions of the State’s building laws.

(6)        This clause applies to a development consent granted before 1 July 2004 only if the building work, subdivision work or demolition work involved had not been commenced by that date.

Note: Principal certifying authorities and principal contractors must also ensure that signs required by this clause are erected and maintained (see clause 227A which currently imposes a maximum penalty of $1,100).

4)      Notification of Home Building Act 1989 requirements

(1)          For the purposes of section 80A (11) of the Act, the requirements of this clause are prescribed as conditions of a development consent for development that involves any residential building work within the meaning of the Home Building Act 1989 .

(2)          Residential building work within the meaning of the Home Building Act 1989 must not be carried out unless the principal certifying authority for the development to which the work relates (not being the council) has given the council written notice of the following information:

(a)  in the case of work for which a principal contractor is required to be appointed:

(i)    the name and licence number of the principal contractor, and

(ii)   the name of the insurer by which the work is insured under Part 6 of that Act,

(b) in the case of work to be done by an owner-builder:

(i)    the name of the owner-builder, and

(ii)   if the owner-builder is required to hold an owner-builder permit under that Act, the number of the owner-builder permit.

The application for a Construction Certificate is to include plans and specifications that indicate access and facilities for persons with access disabilities to and within the development in accordance with AS 1428.1 – Design for Access and Mobility and Part D3 of the Building Code of Australia.

Such plans and specifications must be approved as part of the Construction Certificate.

 

6)      Developer Contributions to be paid

Contributions set out in the attached Schedule are to be paid to Council. Contributions are levied in accordance with the Byron Shire Council Section 94 Development Contribution Plan 2005 dated June 2005 and Byron Shire Council Section 94 Development Contribution Plan 2005 Amendment No. 1 dated 20 July 2005 for Community Facilities, Open Space, Roads, Car Parking, Cycleways, Civic & Urban Improvements, Shire Support Facilities and Administration. The contributions payable will be adjusted in accordance with relevant plan and the amount payable will be calculated on the basis of the contribution rates that are applicable at the time of payment.

7)      Certificate of Compliance – Water Management Act 2000

A Certificate of Compliance under Section 307 of the Water Management Act 2000 is to be obtained from Byron Shire Council prior to the issue of a Construction Certificate and/or use of the development for payment of developer charges for water supply and sewerage.

All such works shall be completed at the applicant’s expense.

b)      Prior to the occupation of the building an emergency and evacuation plan is to be prepared for the facility that complies with Section 4.2.7 of ‘Planning for Bush Fire Protection 2006’ and with the NSW Rural Fire Service’s “A Guide to Developing a Bushfire Evacuation Plan” to the satisfaction of the consent authority.

c)      A self supporting colorbond fence be provided for a distance of approximately 2m or to the property boundary, whichever is the lesser inside the existing brushwood fence to the east of the existing masonry external walls located on the site boundary of Pavilion C and D and be installed at least the height of the existing bushfire wood fence

15)    Works to be completed prior to issue of a Final Occupation Certificate

All of the works indicated on the plans and approved by this consent, including any other consents that are necessary for the completion of this development, is to be completed and approved by the relevant consent authority/s prior to the issue of a Final Occupation Certificate. This includes completion of works within the Road Reserve approved under Section 138 of the Roads Act.

Any Security bond paid for this application will be held until Council is satisfied that no further works are to be carried out that may result in damage to Councils road/footpath reserve.

16)    Access and facilities for persons with disabilities are to be provided 

Access and facilities for persons with disabilities are to be provided in accordance with Part D3 of Building Code of Australia and AS 1428 - Design for Access and Mobility. 

 

The following conditions are to be complied with at all times

17)    Bus Service

The applicant shall ensure that a bus service is provided for each function of capacity and/or frequency to ensure patrons are transported from outside accommodation to this function centre.

18)    No interference with amenity of neighbourhood, as follows 

The proposed use must not be conducted in such a manner as would interfere with the amenity of the neighbourhood.

The applicant shall ensure that no "offensive noise" as defined under the Protection of the Environment Operations Act 1997 is permitted or caused which is likely to harm the peace and quiet of residents on neighbouring properties. 

19)    Maximum number of events per year

Use of the subject allotment is limited to 14 functions per year.

20)    Maximum number of guest per function

There is to be a maximum of 70 guests per function.

21)    No live amplified music

No live amplified music, no third party-provided speakers, DJs, are permitted at any time during any function.

22)    Care required leaving premises

All guests are to be advised to take care when leaving the premises and to be mindful of surrounding residential uses. Signs in prominent positions throughout the premises are to be provided advising guests to leave the premises in an orderly manner, taking care not to disturb surrounding residential uses.

23)    Loading within the premises

All loading and unloading is to take place within the curtilage of the premises, that being within Lot 6 SP81554. All driveways and turning areas must be kept clear of obstructions at all times.

24)    Loading - hours of operation

Loading and unloading at the premises is not to occur between the hours of 10pm and 8am on any day.

25)    Loading noise

Noise generated from loading and unloading must not exceed background noise levels by more than 5 d(B)A when measured at the boundary of the allotment.

26)    Food safety

The applicant shall ensure that food services comply with the NSW Food Act 2003, and only operate in conditions which satisfy the Food Regulation 2010 (incorporating Food Standards Codes).

27)    Restricted hours of operation

The hours of operation are to be limited to between 8am to 9pm for the 14 functions per year.

All functions must cease at 9.00pm.

28)    Temporary Structures

Any temporary structures proposed to be installed as part of any function are subject to separate approval under State Environmental Planning Policy (Temporary Structures) 2007

 

Notes

 

Construction Certificate required:

This development consent is issued under the Environmental Planning and Assessment Act 1979 and does not relate to structural aspects or specifications of the building under the Building Code of Australia. All buildings and alterations require the issue of a Construction Certificate prior to works commencing. Application forms are available from the customer services counter or Council’s website

 

Occupation Certificate required:

The building must not be occupied until the Principal Certifying Authority has issued an Occupation Certificate.

 

Signs require consent:

Council’s Byron Local Environmental Plan (LEP) requires development consent form most forms of advertising signs and structures.  The Council has adopted a policy relating to outdoor advertising that sets out standards for various forms of advertising.  Information is available from Council’s Local Approvals Branch.

 

Disability Discrimination Act:

All development other than domestic construction must meet the provisions of the Disability Discrimination Act 1992 under which civil action may be taken if access for people with disabilities is denied or provide in a discriminatory way.

 

Principal Certifying Authority:

Work must not commence until the applicant has:-

·    appointed a Principal Certifying Authority (if the Council is not the PCA); and

·    given the Council at least two days notice of the intention to commence the erection of the building. Notice must be given by using the prescribed ‘Form 7’.

·    notified the Principal Certifying Authority of the Compliance with Part 6 of the Home Building Act 1989.

 

Protection of the Environment Operations Act 1997:

It is an offence under the provisions of the Protection of the Environment Operations Act 1997 to act in a manner causing, or likely to cause, harm to the environment. Anyone allowing material to enter a waterway or leaving material where it can be washed off-site may be subject to a penalty infringement notice (“on-the-spot fine”) or prosecution.

 

Penalties apply for failure to comply with development consents

Failure to comply with conditions of development consent may lead to an on the spot fine (generally $600) being issued pursuant to section 127A of the Environmental Planning & Assessment Act 1979 or prosecution pursuant to section 125 of the Environmental Planning & Assessment Act 1979.

 

Certificate of Compliance – Water Management Act 2000

A Certificate of Compliance will be issued on completion of construction of water management works to serve the development and/or on payment of developer charges for water and sewer as calculated in accordance with Byron Shire Council and Rous Water Development Servicing Plans.

1.    Background

The former ‘Roundhouse’ site has a long standing history that dates back several decades.

The Land was originally part of a dairy farm, but from around 1969 was used as a sales office for the Ocean Shores development and accommodated a sixteen sided circular building – the “Roundhouse”. 

 

The Land was zoned Special Uses 5(a) – Community Purposes under Byron Local Environmental Plan 1988 (LEP 1988) and on 27 July 1990 the Land and Environment Court ordered Council to compulsorily acquire the Land. The land was acquired by Council on 26 July 1991 and the building demolished in 1993.

 

Rezoned to 2(a) Residential Zone in July 1996, the site was then reclassified ‘operational’ land in March 2002. Development consent for subdivision of the land was granted in April 2003. In July 2014, the land was zoned R2 Low Density Residential under Byron LEP 2014.

 

Subdivision works consequently commenced and were completed in 2014. The blocks were sold at the end of 2015.

 

The ‘Roundhouse’ house land asset has been part of Council's Financial Sustainability Plan for the past four years.  Developed to restore Council’s long term financial sustainability, the plan reviewed how assets can be better utilised to either release funds into new infrastructure projects or retire debt and save the interest 

 

For many years, the north of the Shire has needed upgraded infrastructure and following the state governments Fit for the Future reforms, Council resolved to reinvest the net income from the land sales back into community assets primarily in the north of Byron Shire.

Net income from the land sales was $3.8 million, of which $0.8M will be spent on new projects and $3.0M on asset renewal projects, north of Brunswick River.

Of the $3.8M:

·    $466,700 has already been allocated to the pavement renewal of Kolora Way between Shara Boulevarde and Nathan Court

·    $467,268.05 has already been allocated to the new works of the North Ocean Shores Sports Fields

Council at its meeting on 25 February considered a report on how the balance of the funds could be spent and resolved:

 

1.    That the community be invited to consider the following:

a) a shortlist for renewal works as seen in Table 2.

b) 2 options for the proposed $330,000 budget which will include:

-      option 1 Waterlily Park Playscape $330,000; and

-      option 2 Fern Beach Playground $59,000, South Golden Beach Hall Playground $59,000, Waterlily Park Playscape $100,000 and Devines Hill board walk and amenity improvements $112,000.

 

2.    That the results of the community consultation be reported back to Council.

3.    Consultation approach

Byron Shire Council carried out consultation from Monday 11 April to Monday 9 May, 2016.  The purpose of the consultation activities was to inform the community and local residents on the thirteen shortlisted renewal projects options and to provide the community and stakeholders with the opportunity to provide feedback.

 

The consultation objectives were to:

1.    Build relationships with stakeholders in the north of Byron Shire.

 

2.    Encourage residents in north of Byron Shire to review the Council prioritised works shortlist and provide feedback on their support or other recommendations.

 

3.    Work collaboratively to arrive at a list of priority projects to expend the funds derived from the Roundhouse land sales.

 

4.    Encourage the use of and commitment to community facilities and spaces by including local stakeholders in the planning processes.

Community members were encouraged to provide their feedback, leave comments and make submissions at the information stands, online or via mail, email or phone contact with the project team.

5.    Consultation results

During the consultation period, Byron Shire Council received 5 submissions from community members via email, phone and mail. A total of 257 online budget allocators were completed and included 172 issues were raised in the submissions received. The online budget allocator allowed the community to spend up to $2.86 million out of a potential $4.9 million. Plus, 5 brainstormer feedback suggestions and 32 map pinpoints suggestions were received.

 

When reviewing the issues, it is important to note Byron Shire Council will take into account the status of the road asset, its respective renewal priority and community feedback in order to help arrive at a preferred outcome to allocate funding.


 

5.1     Playgrounds and Open Spaces – quantitative results

 

From a quantitative perspective, community feedback has shown that the preferred $330,000 spend on Playgrounds and Open Space should be allocated to Option 2 with the funds spread over a number of projects (refer Chart 1) with 75% of the respondents choosing this option.

5.2     Road Renewals – quantitative results

 

On the issue of Road Renewals, the results were considerably closer with support for the eleven short listed projects ranging between 7% and 11% (refer Chart 2 below).

1.  Balemo Drive

Balemo Drive Ocean Shores should be under consideration for a serious upgrade. It was torn apart by the heavy-vehicles using it as an access road during the highway construction and has not been fixed properly since. The subsequent pothole damage made worse by repeated heavy rains and continual patching is ridiculous and dangerous, as are most if the main arterial roads throughout ocean shores.

After review of the submissions this project has not been proposed for funding in the report to Council on 9 June 2016.

 

2.  Balemo Drive

Please add Balemo Drive (north end).  Playgrounds need to have disabled access to play ground/parks including the play equipment. Pathways need to be accessible by wheelchairs - no gravel.  Transfer hoist required at playgrounds to shift child/person onto the equipment - will protect injuries to the carer and disabled person.

There are other roads and streets of high volume traffic use eg Balemo Drive, which would benefit from road funding.

I consider the work on Coomburra to be of utmost importance due to the safety issues involved. This is a very steep street with sweeping corners that are very uneven. I also consider the allocation of funds to waterlily park important. This space has great potential but is currently difficult to access and poorly maintained.

9.     Coomburra Cres

I have lived off of Coomburra for 20 years the road is in a terrible and dangerous state.
I would love to see this road resealed. Travelling on this road is highly undesirable as there is more pot holes then road and to see the continual re fill of holes seems like a bad way to handle the situation.
Surely it would be cost effective to fix it properly.
I also think that it devalues our properties.
I could go on and on but I think I would only be stating the obvious.

I live on Coomburra Cres and it is a disgrace. It is a major bus route and is in desperate need of a full reconstruction. The noise from utes, trailers and trucks rattling down the hill is constant. Orana road is not far behind.

Bicycle paths should have priority in an environment such as ours to encourage healthy, non polluted living. Children have very few safe options. At least put cycle paths on main roads.

I read the NSW government has committed $37 million to pathways and cycleways in NSW, including Northern Rivers. I live in Ocean Shores, where it is impossible to walk anywhere except down Raja Rd to the shops. We are desperate for a pathway along Warrambool Rd to the beach, or even to Devines Hill. In Ocean Shores, you have the choice of walking on the road or walking on what is usually a very boggy greensward. This could be such a healthy place to live if it had walking paths. It would also increase the friendliness of the community, rather than watching everyone drive by in cars. It is time to make walking a priority in Ocean Shores. Then the road would be used less!

Council's highest priority for infrastructure works in 2003 was cycleways to provide active transport across the Shire, and you completed a Bike Plan in June 2008.  If you're truly sincere in providing proper playground facilities in Ocean Shores, then you need to link the RTA cycleway from Brunswick Valley Way, along Balemo Drive (eastern side) and continuing along Orana Rd, (including a road crossing at the entrance to Waterlily Park) continuing along Orana, turning right down Yengarie/Rajah Rd to the Ocean Shores Shopping Centre.  Our rates and roads2recovery should be funding our road reconstruction, NOT sale of Council properties in Ocean Shores.  We would estimate the funding for these much needed cycleway to be $600,000 to finally provide safer, healthier active transport for the north of the Shire.

With regard to option 2 playground options I would suggest that the Devines Hill board walk NOT be done and that the available funds be spent improving the cycleway from the South Golden Beach hall to the New Brighton Rd as this is a highly used cycleway which needs upgrading. The resurfacing of Beach Ave should also be done from the curb and gutter cut-off to the north to the levy crossing on Redgate Rd as this is the primary walking and cycleway used by all age groups in SGB.

Road renewal should not rely on the funding gained from the one off sale of land. Road renewal should be provided from recurrent Shire funding or sought from other special State or Federal funds. What is budgeted from recurrent Council funds that would match any use of these funds for that purpose?
I wanted to express a high priority need not reflected in the choices. Ocean Shores has no proper walking path/cycle ways on most of the important walking and cycling routes. There are no verges on the road and it is very unsafe to walk and cycle to the shops and beach. Orana and Rajah Roads at the very least should have this infrastructure. Better lighting at night is also an important security issue. People should be able to walk or cycle safely and securely in their local area rather than relying on cars all the time.

Fern beach already has tennis/basketball court that kids can skate on. Water Lily only has a fenced off court that kids can't use and pitiful play equipment for so many families.

I have lived in Ocean Shores for over 20 years and in all this time we have not had an effective voice on Council and probably never will because of the influence of self interested minority groups who continue to divide the community to pursue their own "band-wagon"causes, the Roundhouse sale being only 1 instance of these peoples negative effect on progress within the community. Perhaps some of the money available could be used to set up a truly independent and democratic Community group although I fear that the current "politicers" would find a way of controlling such a body and it would therefore be ineffective.

Edges also need repair to give more safety to bikes and pedestrians and parking.

I actually don't care too much about the identified priorities and just chose the cheapest. I did register to do my own budget but the link didn't work and I don't have the time to muck around and get it sorted so here I am. We live near the lookout at 20 Warrambool Rd Ocean shores and cannot get internet! Seriously! Neither can our neighbours. Apparently council has limited influence. Really? I find this absolutely ridiculous. We pay our rates like everyone else but unlike most others in the shire we have no internet option since Linknet went out of business at end of January this year. This was mainly due to NBN rolling out... the irony?! NBN won't be coming to our street for at least another 2 years. Absolutely not good enough! I study online and work online. I end up at the library or at WIFI cafes most days. Today I am in the library at Byron (which is only open 3 hours on Saturday!) which takes me away from my young family just so I can get some work done. IT is creating a lot of stress in our family. We have our mobile phone internet data which we can share with our computers and other devices but it is painfully slow and usually I give up trying. Surely there must be something that can be done. The reason our household and neighbours cannot get service is due to a few trees being in the line of site to the relay tower at St Helena. Wires Broadband AKA World Without Wires are happy to speak with council and said that another relay tower or the trees being removed would mean we (and our neighbours) could get internet. We are thinking of moving but are trapped really as who wants to live in a house without decent internet in this day and age???

Dear Council, Firstly congratulations on this initiative and public consultation.
I just want to check that the works planned for Kolora Way from Natan to New Brighton Road would include a pedestrian walkway beside the road in this area. There is a very dangerous section leading up to and after the road bridge on New Brighton road. The bridge it self has a small pedestrian path attached, but the road before and after is very narrow and there is no where to walk without stepping out into the narrow road. A lot of people use this road for walking and running, as do cyclists etc. This is the biggest priority in Ocean Shores that I can see. It really needs to be fixed before someone is hit by a car. The traffic speed there is 60km p/h so there is not a great deal of time to take precautions as people drive around the bend at 60km p/h.
The other thing I noted today when visiting the New Brighton Farmers market, is the state of the public toilets. In the means there are no locks on either the door into the bathroom or into the toilet cubicle. It looks like it hasn't been painted or maintained in a very long time. The toilet was reasonable clean, but could really do with an overhaul considering how many people use this facility for sports and markets.

Hello....... I was disappointed that I could not choose an option to: Continue the pedestrian pathway on Kolora Way. (I had to click on a random option, which is not 'my say', in order to raise this issue, so please dont take my choice into consideration, as they are not priority)..... PRIORITY NUMBER ONE: The pedestrian/bike path ends just before the traffic bridge (heading south on Kolora Way). Pedestrians and cyclists continuing along Kolara Way, are forced to step out onto the very narrow road before we can join the path again as the erosion around the creek has removed all trace of a path. My 3 year old son, fell into the swamp a couple of years ago, as I was doing my best to keep him on the extreme left side of the road. There is approx 5-10 meters where there is literally no path/ground for pedestrians to walk on. Please. please. fix this, it is an accident waiting to happen. thank you for you time. much appreciate.

It seems crazy that we have to get in the car and drive somewhere to find a good playground. If we could have something a bit like Knox Park in Murwillumbah, that would be fabulous.

Speed mitigation and reduction of traffic flow is critical in recognition that this is a small village and the road is not suitable to carry high volumes of traffic.

Also, would love to see allocation of more funding towards facilities projects on the expense of road infrastructure - primarily projects that will increase accessibility to public spaces in Ocean Shores. For example - a boardwalk along public spaces of the river (behind the shopping centre), or a youth sailing school in the North bank of the river, opposite the Marina in Brunswick Heads .

It would be nice to have parkland put along side the Ocean Shores Shopping village there is no access to the river for the young people. A pedestrian Crossing from the Community centre across to shopping centre. Young children and elderly people are taking their lives into their hands crossing a now busy road.  And it would be good to have speed bumps in Coomburra Crescent if you repair it as it is a race track now and would be worse when the road is repaired

 Peter Street is absolutely appalling. Whilst on holiday visiting family there, I tried to walk from Robin Street to Peter Street just as it became dark. I had my baby strapped to my body in a baby carrier as I figured this was my safest option considering the condition of the roads. Whilst walking I tripped several times in the many pot holes in the roads however one pot hole in particular on Peter Street brought me crashing down falling on top of my baby. My poor little girl received a severe cut to her head, and bruising and cuts on her left hand. I twisted both my knee and my ankle, rendering me unable to walk for the remainder of my holiday. I was hysterically upset knowing that I had hurt my little girl but also in much pain from my injuries. Byron Council are lucky that I have not pressed charges!

Where funds are allocated, the local community will be consulted on the final design of the playground.

The south side of ocean shores does not have any public parks for recreation.
Future should consider purchase of the Baptist church for a future library, dog and children’s playground. There could be a fenced playground at the front of the hall and there is a side playground for dogs. There is also room for a carpark. The Brunswick library is too small, no break out rooms, has no carpark and has no room to move.

The Brunswick library land/church has high property value, compared to Ocean Shores. Purchase of the Baptist Church which has an already large building plus the additional land footprint is planning for the growth of the North Byron Community.

The Ocean Shores Community Centre is under high demand during peak times after school 3pm until 7:30pm. The building also has no front entrance or connection to the street of Rajah Road.  A front entrance with public art of the story of Ocean Shores from indigenous, the dairy settlers, and the development of OS into the community today is suggested to assist with giving Ocean Shores the identity it needs.  Also an extension of the meeting room and change of flooring and some small consult rooms and public seating is suggested.

Firstly, part of River street was done around 4 years ago, I hope you do not plan to do it all.
Also - The new sport field at ocean shores, Several people from the community asked to add a basketball court. There is no one full basketball court in Ocean-shores/New-Brighton/South-Golden-Beach/Brunswick heads. Kids have to travel all the way to Mullum or Byron Bay if they want to play basketball. It is a small investment and requires no maintenance.
Lastly - I believe that instead of doing the small streets in South Golden Beach you can instead redo the big one in the neighbourhood: Royal Avenue, which is exactly in the same condition as the small ones, but have more traffic.

I served 8 years on Byron Council's Cycleways Committee to finally deliver a Cycle Plan for this Shire in 2008. Balemo Drive and Orana Rd were high priority in Ocean Shores to connect our kids to Schools and Parks, but this still has not happened. Please provide the cycleways you promised in 2008.

The clearing and fencing of the south golden beach easements were scheduled for last year. They were postponed and there has been no update since. The are hazardous, overgrown and a fire risk.

fix Coomburra Drive properly. The whole road needs to be ripped up and remade as filling in potholes does not work. Many people drive on the wrong side of the road to avoid potholes which could cause a serious accident or damage the suspension of cars. This road has been an on-going problem for years.

The bridge on Kolara Way and the "path" leading towards New Brighton is a dangerous part of North Ocean Shores for foot pedestrians and cyclists- an accident waiting to happen.

Youth in North Byron Shire are in a desperate need for local accessible activities. How about building a sailing school run by local volunteers, and create boardwalk that will lead to the school from the shopping centre?

25.    SGB Ratepayer

Every street in the quadrant of Helen, Royal, Gloria, and Pacific Esp. (Robin & Peter St) inclusive, need complete reconstruction and resurfacing. These streets are a disgrace and are totally unacceptable. some with potholes up to 300mm deep. We have no curb and guttering nor are there properly constructed footpaths, so you have parents with babies in strollers with no where to walk but the middle of the road, which in this day an age is not only unsafe but just plain ridiculous. This matter needs URGENT attention before someone is killed.

The road renewal projects will do this for the roads selected

26.    SGB Skate park

SGB is lacking in recreational facilities for teenagers. A skate park with grass, seating area and jumps as opposed to a skate bowl on the road reserve adjacent to Helen St & Redgate rd would provide much needed infrastructure for our youth. The skate park could be located next to the proposed playground.

27.    the pocket road

Sections of the pocket road are terrible and needs to be resurfaced not just patched up.

Location not in the north of the Shire where the funds are proposed to be spent by Council.

28.    Timber Walkway at Lookout

Construct a raised timber walkway for approximately 60 metres to go over the heavily rooted area. As many people use this path to get from the parking area to the trig station point, the raised roots have created a safety problem whereby people are prone to trip and injure themselves. Many older people have commented on the danger.

 

Forms part of option 2.

Where option 2 is a decision of Council, further consultation will be undertaken with the community as to detailed design elements.

29.    Tongarra Drive Resurface

Tongarra Drive needs to be resurfaced as the potholed street is a traffic hazard to all who use it. This street is used by locals and tourists to access the best lookout in this coastal region. The poor condition of the road gives a deplorable image of Byron Shire to visitors to the area.

After review of the submissions this project has not been proposed for funding in the report to Council on 9 June 2016

30.    Traffic calming Orana bridge

The bend on Orana Road leading to the bridge over Marshalls Creek should have traffic calming devices. One on the west side near Wirree Dr the other on the east or New Brighton side. This bend is a notorious accident site and should be regarded as a "black spot".

31.    Waterlily Community Playscape

Ocean Shores has never had a proper playground for our kids, and we need one desperately. A decent playground would cost $300,000. The recent one built in Knox Park Murwillumbah cost Tweed Council $410,000. We need proper facilities here please.

1.  Thank you for the opportunity to contribute.

 

It would be disappointing to see the funds go on roads. That kind of infrastructure is surely part of councils planned works (and if I may say, responsibility) anyway? Whilst on that topic, guard rails along the path through the green corridor at start of Shara Blvd would increase pedestrian safety. Also, along path b/w the top of Redgate Rd and the current soccer field. Feel very vulnerable to traffic along both of those walks.

 

It would be heartening to see projects undertaken for our youth. The sport field is great. Perhaps a skate park could be added to that. Or near the shopping centre? Somewhere! Hope some playground equipment will be included at new sport field too!?

If our youth are taken care of, our future is taken care of!

2.  I am writing to express my desire to have the surface of Coomburra Cres, Ocean Shores, replaced.

 

I saw the card from your office to ask us to get involved with your survey, but it was unclear how to add my interest when there was already a "pin" on Coomburra "Drive" (they incorrectly named it this instead of Cres).

 

I think it important to also resurface Wahlooga Way, and possibly a short section of Yamble Drive (between Coomburra Cr and Wahlooga Way), so that residents have a smooth surface for this through-way to get to Orana Rd. This is the route that everyone must take in order to get out of our neighbourhood and out the Brunswick Valley Way. It would be rather pointless to beautifully replace Coomburra Cr and then leave Wahlooga Way littered with potholes.

 

Also, as the curbs in Coomburra Cr are broken and generally in a very bad way, will these be replaced when the road is resurfaced?

 

Coomburra Cres recommended in report to Council other roads are not.

3.  As part of this allocating of new available “Roadhouse” land sales funds (see attached a request for ideas from council), is it possible to have funding finally allocated to this safety work on Coolamon Scenic Drive. We have waited enough time since the recommendation was made by the traffic committee.

 

Additional traffic has since been directed our way with new tourist signage. It would have been more sensible to do the line marking before the signposting was erected.

 

Please advise what is to be done.

I would like to submit the following suggestion for the north Byron Shire infrastructure funding:

 

Build a pipeline along the Brunswick rail corridor to take the treated effluent from West Byron STP and pump it into the Simpson Creek which feeds into the Brunswick River (the track could still be used if the rail line were to be reinstated in the future). This is of high priority due to the increased flows of treated effluent from the WBSTP not being matched by reuse, as was a condition of the EIS, and council's inability to deal with this since the upgrade.

Playground & Open Spaces

 

Option 2 provides for funds for a South Golden Beach Hall Playground.  Where Council resolve this option, detailed consultation on design and position will be undertaken, leading to the option of planning for a future skate park within the adjacent road reserve.

Detailed constraints mapping of drainage and services is needed to inform design and costing of a skate park at this location that will inform funding to be sort.  Establishing this as a project will need allocation via Councils budget process / contributions plan.

Response: Funding from the allocation of the former ‘Roundhouse’ sale has not been considered as a short listed project. The Brunswick Head River is a Crown managed waterway.  The main arm of the Brunswick River was dredged in 2015.  Council will consider the effect of sedimentation of the river when it completes the North Byron Flood Risk Management Plan; when completed and adopted, the plan may provide actions to be undertaken.
