MINUTES OF THE BYRON SHIRE COUNCIL Byron Shire Reserve Trust Committee HELD ON Thursday, 22 June 2017 COMMENCING AT 2.25PM AND CONCLUDING AT 3.17PM

The Mayor opened the meeting and acknowledged that the meeting is being held on Arakwal Country and that we pay our respects to the elders past and present and extend our respect to the Bundjalung clans whose lands and waters are part of the Shire.

 

 

Public Access

 

Prior to dealing with the circulated reports and associated information, a Public Access Session was held and the Committee was addressed on the following:

 

Report No. 4.1        Request for Temporary Licence to permit equestrian activities access through Lot 407 DP 729057

 

Kate Noller, representing Zephyr Horses, addressed the Committee in favour of the recommendation.

 

Report No. 4.2        Adoption of Policy 5.52 Commercial Activities on Coastal and Riparian Crown Reserves and Request for Tender - Commercial Activities Sub-Licences.

 

Rusty Miller, representing Rusty Miller Personalized Surfing Instruction,  addressed the Committee in favour of the recommendation.

Vanessa Thompson, representing Mojosurf, addressed the Committee against the recommendation.

 

Submission No. 1 Proposed Changes to Tour

 

Ricky Jacobson, representing Byron Stand Up Paddle, made a submission to the Committee regarding proposed changes to tours his company provides.

Report No. 4.1             Request for Temporary Licence to permit equestrian activities access through Lot 407 DP 729057

Resolved:

1.       That Council, as the Reserve Trust Manager, subject to DoL Lands and Forestry consent, authorise the General Manager to grant a temporary sub-licence for a term of twelve (12) months commencing from the 1 July 2017, to Zephyr Horses for the purpose of access through Lot 407 DP 729057 on condition:

 

a)   that the temporary sub-licence remains valid during the term so long as Zephyr Horses holds current permits with Cape Byron Marine Parks or National Parks and Wildlife Services or both; and

b)   that Zephyr Horses prior to recommencing commercial equestrian activities through Lot 407 DP 729057 stabilises the access track to the satisfaction of Council and ensures that all future equestrian use of the access track does not cause future erosion or damage to the dune vegetation; and

c)   that Zephyr Horses ensures that the whole of the access track if kept  free of all horse droppings.

 

2.       That licence fee for the term of the temporary licence is set at a rate of minimum annual Crown Rent of $472.00 (ex GST).                                                                 (Spooner/Ndiaye)

Report No. 4.2             Adoption of Policy 5.52 Commercial Activities on Coastal and Riparian Crown Reserves and Request for Tender - Commercial Activities Sub-Licences.

Resolved:

That Council as the Reserve Trust Manager:

 

a)      Adopt the Draft Policy 5.52 – Commercial Activities on Coastal and Riparian Crown Reserves with a minor amendment to remove the duplicate clause 8.14 and to insert the words ‘per day’ at the end of clauses 5.2 and 5.3 in Schedule D ‘Sea Kayaks, in the attached Draft Policy following consideration of all submissions received; and

 

b)      Authorise the General Manager to use the open tender method to establish sub-licences for commercial activities for Surf Schools, Personalised Surf Schools, Stand Up Paddle Board Schools and Sea Kayak Tours under authority of Crown licence Rl564194; and

 

c)      Authorise the General Manager to extend current commercial activity sub-licences granted under Crown authority Rl406617 due to expire on 31 August 2017, for an additional period of two months to 31 October 2017 to allow for a fair and open tender process to re-let new commercial activity sub-licences.                                                           (Richardson/Spooner)
