MINUTES OF THE BYRON SHIRE COUNCIL Extraordinary Meeting HELD ON Thursday, 12 May 2016 COMMENCING AT 9.04AM AND CONCLUDING AT 10.34AM

The Mayor opened the meeting and acknowledged that the meeting is being held on Arakwal Country and that we pay our respects to the elders past and present and extend our respect to the Bundjalung clans whose lands and waters are part of the Shire.

 

 

PUBLIC ACCESS

 

Prior to dealing with the circulated report and associated information, a Public Access Session was held and Council was addressed on the following:

 

4.1       Public Exhibition of Draft Coastal Zone Management Plan Byron Bay Embayment

 

Donald Maughan (President, Suffolk Park Progress Association) addressed Council against the recommendation.

Staff Reports - Sustainable Environment and Economy

 

Report No. 4.1             Public Exhibition of Draft Coastal Zone Management Plan Byron Bay Embayment

Moved: That the draft CZMP shall not be placed upon public exhibition until the following additions and annexures are included:

 

1.    A comprehensive consideration by staff of the PRG feedback on the 7 April 2016 version of the draft CZMP, noting staff comments that currently this has not been possible due to time constraints, thus failing to ensure objectives 2 of the 3 objectives of the PRG have been achieved.

 

2.    A comprehensive consideration by staff of the Office of Environment and Heritage (OEH) feedback on the 7 April 2016 version of the draft CZMP, noting staff comments that the draft CZMP BBE timeframes, as per Res16-028, did not allow for a further review by the OEH of the Management Study or Cost Benefit Analysis (CBA).

 

3.    A review of the updated CBA by the OEH.

 

4.    Regarding Implementation Schedules-Open Coast Ecosystem Health, results of appropriate investigations in relation to potential impacts of the works on coastal ecological communities

 

5.    Council’s commitment to proactively ameliorate any off-site impacts resulting from proposed protection works is outlined

 

6.    Articulation of further adaptive management stages; including: the proposed funding models, indicative costing, identification of sand sources for transfers, designs of works and impacts of each adaptive stages.

 

7.    Minutes of a further Community Focused Workshop that achieves attendance by a broad representation of the community, with affected landowners also present, is tabled.

The motion was put to the vote and declared carried.

Crs Ibrahim, Cubis, Woods, Wanchap and Hunter voted against the motion.

 

FORESHADOWED MOTION

Resolved that Council endorse the draft Coastal Zone Management Plan Byron Bay Embayment, at Attachments 1 to 5, for public exhibition and proceed with the public exhibition for a period of not less than 21 days, from 14 May 2016 to 6 June 2016, in accordance with section 55E of the Coastal Protection Act 1979, as per the Exhibition Activities detailed within the report. Prior to exhibition amend Table 1 in reference to the PRG feedback provided to staff, the date to be amended from 10 June to 11 June.  Two days to be listed in the Details column.                                                                                                                               (Ibrahim/Wanchap)
