Report No. 6.1       Dedicated parking for parcel pick-up Byron Farmers Market

The purpose of this report is to dedicate 5 parking spaces to the Byron Farmers Market Inc, Licensee of Farmers Markets on the Butler Street Reserve to run a parcel pick-up service for its customers during the weekly farmers markets.

The Farmers markets are held on the Butler Street Reserve every Thursday between 7am and 11am.  The Byron Farmers Market Inc is the Licensee of the markets to 31 October 2026.

On the 3 February 2022 market, the Licencee was found using disabled parking bays on Somerset Street as a loading zone for its parcel pick-up service that resulted in a warning letter from Council.

The existing parking on Somerset Street is timed 90 degree parking.  Parking is prohibited between the hours of 1am to 6am.

The licensee requests approval to use 4-5 parking spaces between the new and old disabled parking bays (refer Image 1 and 2) on Somerset Street each Thursday for a parcel pick up service during market hours.

The parcel-pick was created by the market manager because customers complained that they could not get a carpark close to the market and had to park a long way away and could not carry goods purchased from the markets.  Customers now leave goods at the managers tent near the disabled car parks on Somerset Street with customers returning in their vehicles to collect at the parcel pick up.

Prior to the parcel pick-up service, customers were double parking near the managers tent to collect purchases.  The creation of a parcel pick-up allows customers to legally park to collect purchases and allows traffic to flow freely on Somerset Street during a Farmers Market.

The following is proposed to facilitate a 15 minute vehicle loading zone on market days only:

·    The installation of “loading zone, 15 minute, Thursday 7am-11am” signs on the existing sign posts between the old and new all access parking bays on Somerset Street, Byron Bay.

 

·    Removal of old disable parking bays pavement markings to the left of the proposed loading zone to reduce confusion surrounding parking restrictions.

RECOMMENDATION:

That Council support:

1.   The use of 5 parking spaces located between the old and new disabled parking bays on Somerset Street, Byron Bay to the Byron Farmers Market Inc during the weekly farmers markets for the period of their lease.

 

2.   The installation of “loading zone, 15 minute, Thursday 7am-11am” signs on the existing sign posts between the old and new disabled parking bays on Somerset Street, Byron Bay.

 

3.   Removal of the old disabled parking bays pavement markings to the left of the proposed loading zone to reduce confusion regarding parking restrictions.

Council staff have been made aware that illegal camping is occurring adjacent Heritage House and Ashton Street in Bangalow.

The current informal parking arrangement and lack of regulatory parking signage makes the issuing of infringement notices in this area difficult for Council’s Enforcement Team.

The following signage recommendations (refer Figure 2) are proposed to deter people from illegal camping and to assist Council’s Enforcement Team in effectively carrying out their duties:

·    The installation of “No Parking Area 1am – 6am” and “prohibitive activities” signs at the entrance to the informal carparking area adjacent Bangalow Heritage House on Ashton Street, Bangalow.

·    The removal of the existing “all day free parking” sign at the entrance to the informal carparking area adjacent Bangalow Heritage House on Ashton Street.

RECOMMENDATION:

That Council:

1.      Support the installation of “No Parking Area 1am – 6am” and “prohibitive activities” signs at the entrance to the informal carparking area adjacent Bangalow Heritage House on Ashton Street, Bangalow.

 

2.      Support the removal of the existing “all day free parking” sign at the entrance to the informal carparking area adjacent Bangalow Heritage House on Ashton Street.

Report No. 7.1       Clays Road & Coral Avenue upgrade

Council has received a Subdivision Works Certificate application associated with stage 8 of the Tallowood Estate development in Mullumbimby for 47 new residential lots.  As part of the approved D.A (10.2020.97.2) consent condition 19 a) imposed the following requirement:

a)      Clays Road  and Coral Avenue upgrade

Clays Road and Coral Avenue must be upgraded from the intersection with Plover Parkway up the existing seal in Coral Avenue. The upgrade shall also include the Plover Parkway/Clays Road intersection and Clays Road/Coral Avenue intersection and associated drainage. The full section of the Clays Road and Coral Road upgrade must be in accordance with a rural residential standard road in Table T1.27 of Chapter D1.0 of Northern Rivers Local Government Guidelines and Construction Manual.

 

The finish surface level of the road must be at or minimally above the existing natural ground surface level.

 

Council’s Development Engineer has assessed and is satisfied that the plans at Attachment 1 have incorporated the above conditions into the design.

 

The purpose of this LTC report is to gain Council support for the proposed regulatory signage and line markings shown in attachment 1.

 

  

 

RECOMMENDATION:

That Council support the regulatory signs, lines and traffic control devices associated with the Clays Road and Coral Avenue upgrade, as shown in Attachment 1 (E2022/19154)

Report No. 7.2       Event - Byron Triathlon 7 May 2022

Summary

Council has received an event application for the 2022 Byron Bay Triathlon to be held on Saturday 7 May 2022.  The course used by the swim, run and cycling legs are the same as previous years. The event organisers are seeking support for the proposed road closures.

It is noted the following the 2019 and 2021 event concerns were raised with extent and duration of road closures created by this event.  Byron Bay continues to grow as a town, which is resulting in more traffic on the roads, therefore the impacts of this event will be greater each year.  This issue was reported to Council on 24th March 2022 and Council agreed to support the existing route as follows.

Resolved (22/101) that Council:

1.      Notes the importance of the Byron Triathlon event to the local community and businesses, as well as the Australian sporting community in general.

2.      Supports the 2022 Byron Triathlon and future events using a similar route to the 2021 event as per attachment 2, and that this route is endorsed by Council, on the basis that the route is supported by the Local Traffic Committee at its April meeting.

3.      Communicates its position to the local community via media release.

4.      Requests the community and businesses respect this decision and support the organisers in the delivery of the 2022 Byron Triathlon.

5.      Council requests that the Byron Triathlon and NX Sports provide to Council evidence of their status as a not-for-profit including registration with the Australian Charities and not-for-profit commission (ACNC) and any details of disbursement of funds to charities or other financial details that give evidence of their status as a not-for-profit organisation.

2022 Event Course

The run leg of the triathlon will require traffic control within Lawson Street.  Refer to Figure 1 for the Run leg.

The cycle leg will require significant traffic control.  Refer to Figure 2 for a map of the cycle leg.

The Middleton Street car park will be closed and used as a Transition zone, as per previous years.

Proposed Road Closures

The proposed road closures and the time of the closures are shown in the table below. 

It is noted in the table provided in the application, the proponents proposed that Bay Street is to be closed between the surf club and Fletcher St.  This would prevent the use of Main Beach Car Park and Lawson St North car parks as there would be no exit route. It is considered the closure of Bay Street between the surf club and Fletcher St is a typographic error and should be that Bay St is closed between Fletcher St and Middleton Street, with access to the Main Beach Car Park not closed.  The table below, from the application, has been modified to reflect that change which has also been included in the recommendations.

The following requirements have been included in the recommendation:

The following roads are proposed to be closed from 4am – 10.30am:

·    Middleton St             - from Lawson St to Marvel St

The following roads are proposed to be closed from 5am – 10.30am:

·    Marvel St                  - from Middleton St to Tennyson St

·    Tennyson St             - from Marvell St to Browning

The following roads are proposed to be closed from 6am – 10am:

·    Bangalow Rd           - from Browning St to Broken Head Rd

·    Broken Head Rd      - from Bangalow Rd to 166 Broken Head Rd

Traffic Control

It is proposed to manage traffic during the above road closures through the implementation of Traffic Control Plans and the support of police from the Tweed-Byron District.

The police at the previous meetings indicated their support for the proposed closures as they were based on the 2019 plan and had been agreed upon in consultation with the event organisers.

  

 

RECOMMENDATION:

That:

1. That as supported by Council Resolution 22/101 Council endorse the Byron Bay Triathlon to be held on Saturday 7th May 2022, which includes the following temporary road closures below:

2. That the approval provided in Part 1 and Part 2 is subject to:

a)   separate approvals by NSW Police and TfNSW being obtained;

b)  the event organiser provide council with an updated Traffic Management Plan  and Traffic Control Plan for the 2022 event, if required by the Police and TfNSW;

c)   development and implementation of a Traffic Management Plan and Traffic Control Plan(s) by those with appropriate TfNSW accreditation and the holding of current and appropriate levels of insurance and liability cover;

d)  the impact of the event be advertised, and charged at cost to the organisers, via a notice in the local weekly paper a minimum of one week prior to the operational impacts taking effect, noting it must include the event name, specifics of any traffic impacts or road closures and times, alternative route arrangements, event organiser, a personal contact name and a telephone number for all event related enquiries or complaints;

e)   the event be notified on Council’s web page with the event organiser supplying Council with the relevant information;

f)    Access from main beach car park to Fletcher St is to be unrestricted at all times.

g)  Access to Lawson St between Fletcher St and Middleton St to be permitted at all times.

3. That the event organisers:

a)   inform the community and businesses that are directly impacted (eg within road closure zones) via written information which is delivered to the property in a timely manner so as to document, consider and respond to any concerns raised;

b)  arranging for private property access and egress affected by the event;

c)   liaising with bus, taxi and waste operators and ensuring arrangements are made for provision of services during conduct of the event;

d)  consulting with emergency services and any identified issues be addressed;

e)   holding $20m public liability insurance cover which is valid for the event;

f)    paying Council’s Road Event Application Fee prior to the event.
